Terms and Conditions

These terms apply to the use of LoyalCody: by shops that offer a loyalty card to their customers, and by customers who use these cards.

This document is a translation. In the event of any discrepancy between the language versions, the French version shall prevail.

1. Provider

LoyalCody is operated by Alexandre Christinat, Chemin de Rovereaz 21b, 1012 Lausanne, Switzerland.
Contact: contact@alexc.ch

2. The service

LoyalCody enables a shop (the merchant) to create digital loyalty cards, to validate its customers' visits by scanning a QR code and to hand over a reward when a card is complete.

For the shops' customers, using the cards is free of charge. Rewards are promised and handed over by the merchant, who is solely responsible for them: LoyalCody is not a party to the relationship between the merchant and its customers.

3. Account

Creating an account requires accurate information and a password kept confidential. You are responsible for anything done with your account. A merchant account is reserved for professional or business activity.

4. Prices

Essentiel plan, with no subscription, which includes one project (one shop) per account. The merchant pays for each reward handed over to a customer, per calendar month (Swiss time):

  • the first 3 rewards of the month are free;
  • each further reward costs CHF 0.40;
  • the monthly amount is capped at CHF 49.00, regardless of the number of rewards;
  • visits that do not result in a reward, and the cards themselves, are free, regardless of the number of cards and customers.

An account that already has several projects keeps all of them, and they continue to work. It can only create further projects with the Pro option.

Pro option, optional. It adds the features described on the Billing page of the dashboard and covers all projects of the account:

  • projects are unlimited (several shops or several programmes). If the option ends, all existing projects are kept;
  • subscription of CHF 19.00 per month or CHF 190.00 per year, payable in advance for the chosen period;
  • no minimum term, cancellable at any time: cancellation takes effect at the end of the paid period, which is not refunded;
  • while the option is active, the monthly cap on rewards is reduced to CHF 40.00;
  • a free 30-day trial, without a credit card, may be offered once per account. Without a subscription at the end of the trial, the Pro features stop, at no cost.

Prices are in Swiss francs (VAT not applicable). There are no set-up fees.

We may change prices by notifying merchants by email at least 30 days in advance. The new prices apply from the first full month following that notice period and, for the Pro option, from the first subscription period beginning after that notice period.

5. Invoicing and payment

  • the monthly invoice is issued on the 1st of the following month, based on the rewards recorded;
  • if a credit card is saved, it is charged automatically when the invoice is issued;
  • without a card, the invoice is sent by email with a payment link, payable within 14 days;
  • a monthly amount below CHF 5.00 is not invoiced: it is carried over to the next invoice, without ever exceeding the monthly cap (any part that would exceed it is waived);
  • the Pro option is invoiced separately, at the start of each subscription period, to the card entered when subscribing. If no other card is saved, this card is also used to pay for rewards;
  • payments are processed by Stripe. LoyalCody neither sees nor stores card numbers.

Invoices and the payment method can be viewed on the Billing page of the dashboard.

6. Late payment

If a charge fails, a new attempt is made automatically and the merchant is notified by email. An invoice still unpaid 21 days after it was issued results in new visits being suspended on all of the merchant's projects.

During the suspension, customers' cards, their progress and all data are kept. Visits are reactivated as soon as the invoice is paid. Amounts owed remain due.

An unpaid Pro subscription never results in visits being suspended. If its payment fails, further attempts are made and the option remains active in the meantime; if these also fail, the Pro features are switched off. Data is kept and the cards continue to work with the Essentiel plan.

7. Merchant's obligations

  • to hand over to its customers the rewards announced on its cards;
  • to validate only genuine visits, and not to circumvent the reward count;
  • to inform its customers about the processing of their data as part of its loyalty programme;
  • to ensure that its staff members use their access only to validate visits;
  • not to use the service for unlawful purposes or in a way that disrupts its operation.

8. Availability

We do our best to keep the service available at all times, but cannot guarantee it: interruptions may occur for maintenance, updates or a failure at one of our providers.

9. Liability

To the extent permitted by law, our liability towards a merchant is limited to the amount it has paid us over the last 12 months. It is excluded for indirect damage, such as loss of profit. These limitations do not apply in the event of intent or gross negligence (Art. 100 CO).

10. Personal data

Data processing is described in the Privacy Policy. Deletion of an account is requested as explained on the data deletion page.

11. Data processing on behalf of the merchant

For messages sent to customers, the export of the customer list and staff accounts, the merchant is the controller of its customers' data and LoyalCody acts as a processor (Art. 9 FADP): we process this data solely to provide these features, in accordance with the merchant's instructions, and protect it as we do our own data.

The merchant sends messages only to customers who have consented to receive them, and uses exported data in compliance with the law.

12. Term and termination

The service is used without commitment: a merchant may stop at any time and request the deletion of its account. Rewards already handed over remain invoiced. The Pro option is cancelled on the Billing page, with effect at the end of the paid period. We may close an account in the event of a serious breach of these terms or persistent non-payment, after a warning by email.

13. Changes

We may change these terms. Merchants are notified by email at least 30 days before a material change takes effect. Continuing to use the service thereafter constitutes acceptance.

14. Applicable law and place of jurisdiction

These terms are governed by Swiss law. In the event of a dispute with a merchant, the place of jurisdiction is Lausanne. Consumers retain the places of jurisdiction guaranteed to them by law.
